Child Support Injustice. Need help

I am the custodial parent of my two children and recently had to go back to court with my ex. She attempted to have an adjustment done to her child support in a very shady way and almost had it reduced to $20 per month. Needless to say I contested that.

I went to court a couple weeks ago and the judge ordered her to get a job and that child support was to be based on a minimum wage job at 40 hours per week. Before the trial my ex and I spoke with a CSRU attourney and he broke down the whole thing with their financial information chart and hypothesized a job for her at minimum wage at only 30 hours per week and based on said chart the amount would be around $310 per month. The letter I recieved today said "Respondent shall owe current support of $195.00 per month beginning XX/XX/XXXX". Now correct me if I am wrong, but how does 30 hours at minimum come out to $310, and 40 hours at minimum only amount to $195?

Can they really lie to me in the court room and then change the amount behind my back without notifying me first or at least allow me to argue against that? I mean I feel completely backstabbed by the legal system if this is the case. Can I petition the judge directly and find out what the heck actually happened and see if this was done in error? Or is there anything else I can do, or am I stuck for the next 2 years with her getting away scott free?

I called CSRU and tried to find out what this was all about and I was given the brush off. CSRU also stated that there is nothing they can do about the $22,000+ in arrears for child support currently owed. Something is just not adding up here and I could really use some help. Thank you.

I was severely injured at work and am receiving workman's comp. We it comes time for a lump-sum payout will part of it go the the custodial parent even if i am not behind in child support?

I am a 21 year old looking to help my friend to see their child. Im a caring guy and was looking for some help on the matter.

His parents are the legal guardians of his two children and they will not let him or their mother see them. They both have parental rights to the children and they both want to see their child. Any advice would do. Thank you for taking the time to read this.

Law pertaining to emancipation age.

This site states court orders before '97 emancipate support obligation at 18 and the date of the document does determine this. Am I understanding it correctly? If so ,then both Iowa and Nevada law are clear that our obligation was to end on January 12th. Interested to see what Support Enforcement has to say..

My husband's support agreement originated in Nevada but when we moved here 6 years ago Iowa CSRU became involved. Our income lowered drastically when we moved here and he was even unemployed for 18 months during which we tried to contact Nevada CS for modifications to no avail. Nothing happened,no one called back,etc. Case wasn't turned over to Iowa yet so we had to wait to modify w them. Yeah right. To make a long story short our case has never seen a iowa judge inspite of 3 attempts to modify,mothers income has never been taken into consideration. It still remains at a 50k a year salary determination. He makes 10k less here. I do not work,we have 3 children. It has been tough.

So anyway Jan. 12th stepdaughter turns 18. We received a document a month before from CSRU stating she may be due to emancipate,fill out forms,etc. We send them in and assume no news must be good news.Our original court order drafted back in 1994 states january 12th we are done. Well,they are still deducting payroll so he contacted central payroll who said it goes thru may til she graduates in Nevada.

We are hurting so bad financially 4 months may mean the difference between losing our house and staying afloat.. Do we have a leg to stand on being our court order states 18 period.

So sick of this. In this kids life,we have paid $33,000 in arrears plus 17 years of support. Haven't spent that on my kids that's for sure but we all know my kids don't matter according to CSRU. The first $15 k being based on her mother's "estimation" of first year of life expenses for the child plus back support. The others have been seized tax returns,bank accounts and tacked on to support. They were never married,never really dated. Just a very vengeful booty call who makes our lives very miserable.

He was with her the month before we got together. Kept her pregnancy secret until 2 months after we were married. Ohh the drama. Anyway child has zero relationship with her Dad or our girls because of being fed hate all these years.My kids resent being poor when her mom makes more than their Dad does yet no modification is ever made. Its been a nightmare I thought would end two weeks ago. Husband is waiting for a callback from CS as we speak.

We don't have money for a lawyer but shouldn't this original court order GrandFather clause an extension?

Mom filedJoint custody stipulation

Has anyone heard of this? We have had a joint custody agreement since 2004 with myself having primary placement of our daughters, and custody stated as being reasonable and liberal, as of 2006 the girls mom and I have had a verbal shared placement agreement as we have had good communication, now she wants to begin to provide insurance (her husbands which is free) claim the girls on there taxes and have me pay all out of pocket medical expenses....she has never paid child support nor have I, but now she wants this joint custody stipulation with joint physical placement...can she do this she doesn't live in the girls school district and has never expressed an interest in providing financially for the girls. If I take her to court over it what chance do I have of retaining the original custody agreement we have had since "04"

Reversing A Order

Has anyone tried to reverse a order after time has past. All in a nut shell, 7 Yrs. later it has finally come out that I was falsely accused, which I was, but is there a way to remove a name from the registry. I dont need to go into details but I have hard proof of this.

My daughters mother shows up

This weekend I had my daughter and she forgot her meds. Unknown to me my daughter called her mother who told her it was not a big deal. I tried calling her mother 2 times, no answer, so I sent her a text that said I could come and pick it up. No response. Then 4 hours later my daughter gets a texted that says 'we are on way with med's' and just shows up.

We are in the middle of our court case, and I am upset that this mother continues to put my child in the middle. I am upset that she feels she can just show up at my house without discussing it with me.

What are my options?

ex appealed to supreme court... have questions...

My ex appealed to the supreme court after the district court ruled and denied her appeal to him. She won primary care and my visits are e/o Wed overnight and e/o weekend. Everything is very standard. She is very controlling and wants less. Does the supreme court have to hear her case? What are the chances the take it? Her appeal is all he said she said and very petty. The original judge was rolling his eyes in court listening to her. And he based her pretty good in his ruling. Please help... Without lawyer now... Can't afford it!!!

Help in difficulties

Hello everyone. I am new here. I just want to say I have never felt more vulnerable in my life. Just recently, my current wife, my stepdaughter and I packed up all of our belongings, left our jobs, school, and relocated to a different state 5 minutes away from my ex wife and more importantly close to my teenage son and daughter. We made this move to allow me to be more involved in their lives and to be close to them as they fight the challenges of high school. Both of my children were so excited when they heard I was moving to be close to them. Both of them already claiming what room(s) would be theirs when we finally get to there. However, since day one of the move my ex wife has not only made our lives a living hell she has poisoned the minds of my children against me (parent alienation).My daughter who at first was so excited wont hardly ever come over to my house. She is now claiming that I have ruined her life and have made a mess of things. My daughter says the same negative things my ex wife says almost verbatim. One year ago before we moved my son told me and my ex wife he wanted to live with me. He still to this day wants to live with me. But my ex wife wont have it. To make matters worse my ex wife who is now divorced again has met a man online and who lives about 120 miles away. My ex wife frequently brings my children over to this mans house to spend weekends there and even though she has not said so yet, will in fact move my children to live with this man. I have joint custody of my children and this woman can NOT do this. This is NOT in the best interest(s) of my children. This woman is devious. This woman joked about moving a year ago just to get a rise out of me. This woman must be stopped. Problem is I dont know what I can do. I dont have the proper resources or money to even get a lawyer. This woman has also on top of all of this put a claim on my wages for child support the very first week I got a job. The current job I have is but a low paying labor job and I now have problems paying my current bills much less getting a lawyer to stop this woman who is also spreading lies about me and my family to people in a small town. can someone please help me.

Need A Good Attorney/Help

My name is Gary Luck; I am a 22 year old father in Cedar Rapids, IA. I have a son with a woman out of wedlock. As of November 13^th, 2011, she claimed that she could no longer perform the duties of a mother for the time being, and gave me my son fulltime. In late November she filed for Child Support for my son and it was just filed on the 27th of December. Not only that, but she started dating a 31 year old man back in October. It wasn't until late November that I found out that this man that she had around my son is a convicted felon who in her reports as well as reports from her own friends, habitually uses narcotics and is physically/mentally abusive. And due to this new boyfriend, she has gone downhill rapidly. She has no residence, reliable means of transportation, and recently got fired from a very well paying job, due to her attendance, or lack thereof. Back on December 27th, her mother, disgusted with her actions, moved to have her committed in a psychiatric ward, which I added my own affidavit; which was carried out on the tenth of January, during which they did drug testing and found that she too has been using drugs specifically Xanax. I am working part time making ten dollars an hour working no more than 30 hours a week, while also child support has been filed to start withholding from my paychecks. I have attempted to enlist the help of Iowa Legal Aid but was denied. I have called the University of Iowa's Legal Clinic as well as the Clerk Of Court in Linn County in attempt to get some kind of understanding as to the procedure for filing for full custody of my son, but all respond the same way: "enlist the help of a qualified attorney", an action I do NOT have anything close to the funds needed. All I want is the piece of mind that my son will not be influenced by this kind of behavior at all and will be in my care at all times. Can someone please tell me how to go about this to ensure the safety and well-being of my nine month old son?

Mother homeless/living with friends - my rights?

Hello, I have a 7 year old daughter, Ami, and I don't have custody of her though I pay child support. I'm going to be petitioning for partial custody of her pretty soon, and had meant to do so earlier, but my Navy career hindered me in that regard. What are the chances of getting at least partial custody this late in the game?

Also, I have reason to believe that my daughter's mother is homeless and living with a friend. She was also just recently hospitalized for unknown reasons, and she says she has many health problems which is why she lives off the state and my child support checks. I have a major problem when Ami being looked after by strangers and whoever her mother finds to live with. My daughter's been "diagnosed" with ADHD, insomnia, depression and whole slew of other things, coincidentally things her mother also says she has herself. Ami also has said things like "I just don't want to live anymore" and she has peed on herself in class several times recently. What can I do?? I think she's being mistreated and since I live so far away (San Diego) and don't have custody, I feel hopeless.

Is there any legal/other advice you can give me? Thank you!
